Evidence Collected to Support Harassment Charges in Buni Yani Social Media Case
Jakarta. The police's cyber crime investigations unit has collected four pieces of evidence to support naming Buni Yani, a lecturer from a private university in Jakarta, as a suspect relating to harassment via social media, a spokesman said.
“Based on article 148 of the Criminal Law, we have fulfilled four out of five evidence needed … The legal elements have been fulfilled,” Jakarta Police spokesman Sr. Comr. Awi Setiyono said in Jakarta on Wednesday (23/11).
Investigations included examining the original recording of a campaign speech given by Jakarta Governor Basuki "Ahok" Tjahaja Purnama at an event in Pramuka Island, off the north coast off the capital.
“For the original video, we have conducted digital forensic examination, the original takes an hour and 40 minutes. The edited version on Buni Yani’s Facebook account is 30 seconds, starting from minute 00.24.16 to 00.24.46,” Awi said.
“There was no evidence of changes or adding Basuki’s voice from the posted video. The original video was only cut to 30 seconds."
Investigators maintain Buni was named a suspect for an edited caption added to the post on Oct. 6, not for uploading the video.
“The criminal act was not about posting the video, but the three paragraphs on his Facebook account,” he said.
Based on expert witness testimonies, investigators believe Buni's paragraphs have violated article 28 of the Electronic Information and Transactions (ITE) Law.
“Whoever is reading it may be incited, as it created a form of hate related to SARA [race, religion, ethnicity and groups]. We have clarified with witnesses that he actually wrote them,” Awi said.
