Jakarta. House of Representatives Speaker Setya Novanto won a pretrial motion filed against the Corruption Eradication Commission, or KPK, in the multimillion-dollar e-KTP graft case on Friday (29/09).
South Jakarta District Court Judge Cepi Iskandar declared that the court approved Setya's pretrial motion challenging his "suspect" status.
"The pretrial motion judge concludes that the accusation of the suspect is not in accordance with the legal procedure," Cepi said on Friday, adding that the KPK only has evidence from former Home Affairs Ministry officials Irman and Sugiharto and businessman Andi Agustinus, who are suspects in the case.
KPK named Setya as a suspect in the massive e-KTP graft case on July 17, accusing him of playing a leading role in a scheme to swindle funds earmarked for the project.
The Golkar Party chairman could face up to 20 years in jail and a maximum fine of Rp 1 billion ($305 million) if found guilty.
Meanwhile, Cepi added that the investigation against Setya should be suspended.
Setiadi, legal bureau head of KPK, said he respected the verdict, although he said the judge might not have been meticulous in the decision making.
"We will study the verdict for evaluation and consolidation," he said on Friday after the pretrial hearing.
Setiadi said the KPK would refer to a 2016 Supreme Court regulation that allows investigators to issue a new letter ordering the start of an investigation after a suspect status is canceled in a pretrial hearing.
