Mario Dandy Indicted with Aggravated Assault

Jakarta. Prosecutors on Tuesday indicted Mario Dandy, the son of disgraced tax official Rafael Alun Trisambodo, with pre-planned aggravated assault on a teenager in a case that caused public outrage and inquiry into his family.

The case got national attention after the video of the February attack showing him kicking the head of his motionless victim went viral on social media platforms.

The intentional assault has “caused serious bodily harm” to the victim, identified as David Ozora, prosecutors told the South Jakarta District Court.

David, 17, was in a coma for several weeks after the attack and remains under physical therapy to date.

Prosecutors used several articles from the Criminal Code and the Child Protection Law against Mario, 19, who didn’t present his preliminary defense, meaning that the trial will proceed.

He could face a prison sentence of 12 years if convicted.

A second defendant in the case, Shane Lukas, was tried separately by the same court for allegedly becoming complicit in the crime.

The victim’s father followed the hearing in person to make sure that prosecutors brought a tough indictment against both defendants.

Jonathan Latumahina said there was a legal expert who suggested that since his son is recovering from the injuries, Mario deserves leniency.

"My son has not fully recovered to date and we have proof from Dr. Yeremia Tatang from Mayapada Hospital. David still needs treatment from a physiotherapist,” Jonathan told reporters at the courthouse.

“David can only walk for six minutes and he has fallen to the ground many times, including on May 8 which resulted in a fracture in his leg," he said.

The father added that David cannot tell the difference between certain colors since the day of the assault.

“He cannot take a bath or put on pants by himself. So we must hire a nurse to take care of him 24 hours a day,” Jonathan said.

“If there are people who suggest that this is not an aggravated assault, I will fight them.”

The assault triggered a public inquiry into Mario who often flaunted luxury vehicles on his social media posts. It was learned that he is the son of a high-ranking tax official, himself facing an inquiry over his wealth.

Days after the assault, the Corruption Eradication Commission (KPK) summoned Rafael for alleged unclaimed wealth while the anti-money laundering agency also made media statements alleging hundreds of billions of rupiah in suspicious transactions involving the taxman.

Rafael was named a corruption suspect and detained by the KPK in March.
