W. Java Governor, Bekasi Mayor Sued Over Road Fatality

Bekasi. The family of a man killed when his motorcycle struck a large pothole has sued the governor of West Java and the mayor of Bekasi for allegedly neglecting the condition of the road that he died on.

Sulastri Maeda Yoppy, whose father Ponti Kadron Nainggolan, 53, was killed on Feb. 8 when he was thrown from his motorbike on Jl. Raya Siliwangi Naragong in Bekasi, filed a lawsuit with the Bekasi State Court on Thursday.

Sulastri and his family say the West Java provincial government and the municipal government of Bekasi ignored the road's poor condition, which was the primary cause of the crash. They are seeking Rp 809,888,300 ($62,900) compensation.

Ponti was riding his motorcycle along Jl. Raya Siliwangi Naragong when he hit a pothole and was thrown across the center line and hit by an oncoming truck. He was severely injured in the crash and later died at Thamrin Hospital in Cileungsi, Bogor Regency.

"There are so many damaged roads left unrepaired," said Nelson Nicodemus Simamora, a lawyer from the Jakarta Legal Aid Foundation, which is assisting the family. "We file this lawsuit to demand the responsibility of West Java Provincial Government and Bekasi City Government."

The lawsuit targets four parties. It alleges West Java Governor Ahmad Heryawan and the province's transportation agency head should have fixed the road where the crash occurred. It also singles out Bekasi Mayor Rahmat Effendi and the head of the Bekasi Transportation Agency for not installing warning signs about the road's condition.

The lawsuit demands immediate repair of Jl. Raya Siliwangi Naragong, new traffic signs to be installed and a formal apology to the victims' family.

"Money is not our main interest, but [we want them to] fix the road and put up traffic signs," Nelson said.

Jl. Raya Siliwangi Naragong is notorious for accidents. Between January and October 2014, there were at least 51 traffic accidents on the road, killing six people.

Bekasi Mayor Rahmat seemed unperturbed by the impending legal suit, saying "go ahead, it's their right as citizens."
